Ι. ALVO’s Terms and Conditions of use that are detailed below (also referred to as : ”conditions of use” or “T&C”) establish the terms that regulate the agreement between you and ALVO Single Member p.c. (hereinafter “ALVO”), a company incorporated under the laws of Greece, with head offices at 6, Panepistimiou Str., GR-10671, Athens Tax Identification No 801191912, registered at the Commercial Registry of Athens under no 151434501000.
PLEASE READ THE FOLLOWING TERMS AND CONDITIONS RELATING TO YOUR USE OF THIS SERVICE CAREFULLY. BY USING THIS SERVICE YOU ARE AGREEING TO THESE TERMS AND CONDITIONS. IF YOU DO NOT AGREE TO BE BOUND BY THESE TERMS AND CONDITIONS, PLEASE DO NOT PROCEED ANY FURTHER AND DO NOT USE THIS SERVICE.
We reserve the right to modify these conditions of use at any time. Notifications on changes to the T&C will be announced on our website and/or the App. By using this service at any time and/or after we make any changes to these conditions of use, you agree and accept those changes, whether or not you have reviewed them. If at any time you choose not to accept or agree to these conditions of use, please do not use this service.
The glossary for the terms used in this agreement is as below:
- “The service” – An arrangement to pay parking fees for on street parking and parking lots through the use of our and related services, which utilize mobile phones, Smartphone and tablet Apps , kiosk/stores, call center, IVR or our website, named Cello and is operated by ALVO.
- “ALVO and/or Operator” – the company operating the parking arrangement through the use of cellular (mobile) phones, Smartphone applications and online website and its duly authorized officers and representatives, as well as the internet website www.cello-park.gr.
- “The user” – The person who joined the parking arrangement/session, including his/hers heirs, the authorized users allowed by him/her, his/her representative or agent/s and the driver/s on his/her behalf.
- “The account” – The user account that is conducted by an individual or a company.
- “The authorities” – Parking authorities and/or Parking Operators that offer, directly or by an agent on their behalf, paid or free parking space/s for the public.
- “The additional services” – Services which will be provided by ALVO to the user regarding parking payments through basic and user premium services’).
- “The website” – The internet website www.cello-park.gr which is owned and operated by ALVO.
- “Customer service” – ALVO’s customer service operates from 08:00 until 18:00 and for premium users via e-mail.
ΙΙ. Nature of the Relationship
The service provides you with a method for paying parking fees that arise from the use of regulated paid public parking places as well as for receiving additional services. The service does not allow you any right to use the parking areas whatsoever. The responsibility for allocating public parking places, and the extent of the parking fees applicable to those parking spaces, is the exclusive responsibly of the authorities. You should address any complaint or question regarding those matters to the relevant authority. All notices, signs or directions made by relevant authorities, traffic attendants or authorized persons (e.g., the suspension of a parking space) shall take precedence over any information that you receive from ALVO or that is available by ALVO.
ΙΙΙ. Methods for joining the service (How to become a Cello user)
A person who wishes to join the service can do so in one of the following ways:
- Via Cello Smartphone App (if available for your Smartphone OS)
- Contact Cello Customer service through the Call Center or IVR and execute the registration process as directed
- Online via website registration process
Any other method, should it become available, will be detailed in this section now or in the future. A person wishing to join the service is obliged to provide Cello with reliable, correct and accurate information. Should you become aware that the information provided to Cello is false, incorrect or inaccurate, you MUST inform Cello immediately and correct the false, incorrect or inaccurate information. It will be assumed that a user, who has joined the service and accepted the conditions of use, has thoroughly read through the conditions of use, agrees to them, and waives any claim against them.
IV. Methods for using the service (How to use Cello)
As a user, when you wish to use the service, you can do so in one of the following four ways:
- Call from your mobile – Your mobile phone number is linked to your vehicle when you register. Simply call the Cello Call Center /IVR, select the vehicle you wish to park (if you have more than 1 vehicle registered), enter or state the Location and the zone number (if any), the parking spot and confirm the parking activation. When you leave, just call again and the system or the agent will end your session in the same manner. You must have caller ID enabled so the Operator/Cello can identify your account otherwise you will need to state all required information to start a parking session.
- Use the Cello Smartphone app – If you have an Android or iOS Smartphone, you can use the Cello app to start your session. After registering, select the vehicle you wish to park (if you have more than 1 vehicle registered), the Location and the Zone number, parking spot number (if required) and hit ‘start’ to begin. You can check the app to see when your parking session expires based on the limitations of the authorities. When you leave, just hit the ‘stop’ button in the app.
- Use the website online – Use the Cello website and start your parking session by going to the “Park Now” button, selecting the Location, license plate number of your vehicle, telephone number, Parking spot number, Zone number, your vehicle registration number (if you have more than 1 vehicle registered) (if required)and select ‘Start’ mode. When you leave, just select ‘Stop.
- Proceed to a Kiosk/Shop – You can proceed to a Kiosk/Shop that have established an agreement with the Operator and start the parking session after the mandatory entry of the license plate number of your vehicle, the entry of your telephone number and the number of the parking spot of the vehicle, for the immediate update of the system and for sending you the digital receipt through the App as well as the digital PIN code through SMS to you. The digital PIN code you will receive shall be entered to the Kiosk/Shop system to start the session. The transaction will be carried out via Android devices (using your prepaid/credit/debit card or cash) installed at third-party vendors such as kiosks, shops, etc.
Any other method, should it become available, will be detailed in this section. You are responsible for correctly entering or selecting the vehicle and relevant, parking spot, location and parking zone number, which is indicated on the parking meters or signs that apply to your parking space. You should only activate the service after you have found an available legal space. You are also responsible to make sure that a valid parking session has been initiated by you. Cello and its operator ALVO are not responsible for any fines, parking tickets, penalty notices and the enforcement of vehicle parking related offenses you incur or receive. You are solely responsible for resolving with the relevant authorities any issues that you may have regarding the issuance of fines, parking tickets, penalty notices or your vehicle being impounded.
V. Use of the service
A user, who has joined the service, will provide the Operator with the mobile phone number and the vehicle license plate(s) which the user intends to use to operate the service. Activating the service with the mobile phone will be according to the procedure determined by the Operator from time to time. You affirm and approve that you are aware that the use of the service is subject to the availability of the cellular network to which your mobile phone is connected. You take upon yourself full responsibility for checking the availability of the cellular network to which your mobile phone belongs to and for making sure of the acceptance of your messages to the Operator/Cello sent by the mobile phone and of your intention of using the service and/or of your intention to receive additional services. The full and exclusive responsibility for all the implications that may arise as a result of a failure in the cellular network to which your mobile phone belongs will apply only to you. This includes the payment of fines, parking tickets, etc. The use of mobile phones while driving is illegal and dangerous. You are required not to use the mobile phone while driving. Cello and subsequently its operator ALVO will not be responsible for any accidents, damage, loss or injury caused by you and/or due to your use of the mobile phone in regard with the service and/or receiving additional services. We will also not be responsible for any loss or damage that you may suffer as a result of you not using the services correctly or if you fail to comply with the conditions of use or any other instructions given to you by us. The service is to be used by adults only and individuals or companies that can form legally binding contracts under applicable law. Minors should never use the service and shall not be allowed by their legal guardian for any reason to register or use the service. If you do not qualify, you are not permitted to use the services, and you do not have our consent to do so.
VI. Parking fees, payments and invoices
The Parking fees with which you shall be debited by the Operator will be according to your usage and the fees which are determined by the competent authorities, from time to time, and in accordance with the authority’s current fees. Parking fees can be changed by the authorities at any time and modifications to parking fees are beyond our control. Any changes to parking fees by the authorities will result in us updating the fees with the same changes. Upon joining the service you give your consent and approval for the use of the credit/debit card or Prepaid card (given upon registration to the Operator to effect the payment of the parking fees and the services fees (if applicable). The payment of the parking fees and payment for the additional services to the Operator will be done by you by means of your credit/debit card or Prepaid card balance or cash at the Kiosk/Shop. At all times you must have sufficient credit on the card account to pay the fees due at the time we request the payment from the credit or debit or prepaid card company. Should the Operator not be able to collect the payment due from you by means of your credit/debit card or Prepaid card automatically, you are not allowed and permitted to use the service. Your parking transactions history, indicating the vehicle parked, mobile phone used, parking locations, times and costs is available and can be accessible by you at all times in the mobile App and can be downloaded. We do not provide a service to send invoices by mail and if such a service were to be provided it would be subject to additional charges and fees.
If your selected payment method is a Credit/Debit or Prepaid card – your balance will be charged at the end of each transaction. If your selected payment method is cash to the Kiosk/Shop, you will be charged instantly for the duration paid.
In case you decide to switch between payment methods during the month – all transactions that occurred before the change will be charged to the payment method you had up to the change. (Upon changing from prepaid to Credit/Debit card – any prepaid balance remaining will become void).
VII. Basic Services
As a basic user, the Operator/Cello shall provide the users with “Start & End Parking Sessions”, with an option to find a parking space through “The Parking Hunter” and ability to find the vehicle through “Find my Car”. Users shall always allow and permit Cello, to have access on locations services. The Operator shall not bear any responsibility for non-operational occasions of the basic services not attributed its fault and/or gross negligence.
VIII. Premium Service and Subscription fees
Should you elect to subscribe to the premium services which currently include SMS (text) iRemind service, iMoved service and the iSupport service– a service subscription fee €0.99 per month for every vehicle in your account will be added to the parking fees. The fees for the service will be determined by the Operator, from time to time, and will be announced by the Operator on Cello website. You can opt-in or out of the premium services at any time by calling or emailing our customer service. In some authorities, the Operator may be required to charge a transaction fee for every parking transaction made using the system in that authority. In such cases – the Operator will detail those authorities and the relevant transaction fees both under this section of the conditions of use and on the fees page on its website.
IX. iRemind SMS (Text) messages (as part of the premium services)
As a premium user, Cello reminds you how much time you have till your Parking time expires (iRemind). You acknowledge and agree that the receipt of SMS messages is not guaranteed, may sometimes be delayed and may depend on various factors, such as Cellular network availability. You acknowledge and agree that you are responsible for the deactivation of a parking transaction on time or taking action according to parking limitations (such as moving the vehicle on time) regardless if you have or haven’t received the SMS reminder. Cello shall have no responsibility or liability for the damages and costs incurred by the user not receiving an SMS message on time for any reason. The SMS reminder will only be sent when an action may be required by you (i.e. you may need to move your vehicle or extend payment if permissible).
X. iMoved (as part of the premium services)
iMoved is a GPS based service available to premium account holders using the Cello app that is designed to reduce the risk of over-paying, by providing pop-up reminders to end a parking session when normal walking speeds are exceeded. Cello app makes every technological effort to provide the most accurate notification possible. Location services must be enabled for the iMoved service to work. The iMoved service may not be accurate if the parking session is activated inside buildings or in a confined environment. The iMoved service will not work if the parking session is activated via any means other than the app.
XI. iSupport (as part of the premium services)
As a premium user, you have instant and delay-free service and support, either through our call center during working hours or via email at any time. (iSupport). You acknowledge and agree that the Operator has no responsibility or liability for the damages and costs incurred by the user not receiving a reply via email or through call center immediately or within a reasonable time frame, regardless of delay nature, for any reason.
XII. Inquiries regarding charges and/or payments
Should you disagree with a charge that was debited from your account, or dispute in good faith any amount billed to you, you have to address hi@cello-park.gr, as soon as possible, and no later than 30 days after the relevant charge has been debited from your account, and provide us with the following information:
Your name, the name of the driver, your mobile phone number, the vehicle’s license plate , a description of the charge where there is disagreement, giving as much as possible a clear and detailed explanation of why this charge is incorrect and any other relevant information.
Should you address the Operator orally, the Operator is entitled to ask you to send your request in writing within seven (7) working days.
Should this charge be a part of an invoice – you agree to pay any undisputed portion of such invoice when due. At our sole discretion, we may also request that you provide us with more information (which may include call logs, data usage etc.) for us to be able to examine your request. Your failure to comply with these procedures or requests will be regarded as your approval of such amounts billed to you. The Operator will provide you with the results of its examination of the case in regard to your request and/or will inform you of the results of the examination in regard to your request within twenty (20) business days. On rare occasions, THE Operator will be entitled to extend the time for which it will examine the users request by an additional ten (10) business days. In case where the Operator finds that your complaint and/or dispute is justified, the Operator will credit your account within ten (10) business days with the same amount which was charged unreasonably.
XIII. Responsibility in case of stolen, lost, or unauthorized use of the account
You are responsible for all use of your account, including use that is unauthorized unless the unauthorized use is due to the Operator’s negligence. You are responsible for all use of the registered mobile phones, including use that is an unauthorized use by you. You undertake to inform the Operator immediately upon becoming aware of one or more of the following occurrences:
- The mobile phone which is used to activate the service was lost or stolen.
- There has been unauthorized use of the account.
- The credit/debit/prepaid card which is used and registered in the account was lost or stolen.
This information should be provided to customer service by calling the Call Center during working hours. Should an announcement of this kind be reported to the Operator, the Operator will deactivate the account until the issue has been settled and the competent authorities are informed accordingly by you.
XIV. Liability
- User’s Liability
A User agrees to use the Service at his/her own risk & expense. By contracting the Service, you agree to use it in accordance with the law, responding to the Operator &/or third parties, for any damage or harm that may be caused as a consequence of the non-compliance with the obligations derived from these Terms and Conditions of Use. You are responsible for making correct use of the Service, in accordance with the provisions of these Term and Conditions, as well as any other complementary texts that may be provided to you through the Application, our Website and the applicable legislation.
By using the Service, you shall be liable for any damage culpably caused by you and suffered by the Operator and/or by any third party. If, on this basis, there is reason for you to pay compensation for damages to the Operator and/or to any third party, the level of liability for damages shall be dictated by the compensation amounts defined by the Operator. You are entitled to prove no loss has been incurred, or that any loss is significantly below the defined amount. The right to claim for damages exceeding the compensation amount remains reserved.
Regarding the payment of the Service, you are responsible for paying the Operator all the amounts corresponding to your use of the Service.
- Operator ’s Liability
The Operator is entitled, at its sole discretion, to change or suspend the Service with future effect at any time and without individual notice. Information about the discontinuation of the Service shall be provided in good time via the Application, or via the Website or/and e-mail or through the Call Center.
The Operator will be exempt from any liability that may arise from damages, losses & other consequences resulting from the non-compliance with these Terms& Conditions of Use and applicable legislation by the User.
The Operator shall be solely responsible for providing the Service to you and for carrying out the services in accordance with the provisions set in the present Terms & Conditions of Use.
The Operator will be exempt from any liability that may arise from the Use of the Application.
If the User incurs damages in connection with the use of the Service as a result of intent or gross negligence on the part of the Operator, including its employees, organs, and/or legal representatives, the Operator shall bear liability according to Greek law.
In the event of slight negligence, the Operator, including its employees, organs, and/or legal representatives, shall be liable only if a material contractual obligation has been breached; the level of liability shall also be limited to typical damage of a foreseeable nature when the contract is concluded. Material contractual obligations are those whose fulfillment enables the proper execution of the agreement in the first place, whose breach jeopardizes achievement of the contractual purpose, and obligations on whose observance you can regularly rely.
Furthermore, there shall be no liability on the Operator or its operators.
The limitations of liability governed by these abovementioned clauses shall not apply if guarantees have been provided and for injuries to life, body and health.
XV. The users’ access to the website
The Operator hereby grants you a non-exclusive, non-transferable, limited right to access and use the website and the service for your own personal or company use only. You agree not to interrupt, or attempt to interrupt, the operation of the website in any way. We reserve the right to restrict your access to part or all of the website (including any future password protected areas) at any time without notice or liability. It is hereby elucidated that this use is limited and does not include nor permit reselling or commercial use of any kind in relation to the services of the website, collection and use of the information, descriptions or costs whatsoever, use derived from the website or the content of the website, downloading or copying information to the favor of other parties and all use of data mining, robots or similar tools that serve to the collection and extrication of data. It is also elucidated to you that it is forbidden to reconstruct, to duplicate, to copy, to sell, to resell and to exploit in any way any data and information that is connected with the Operator, its service or its website. You are not entitled to use any intellectual property, trademark or graphical design that is owned by the Operator and/or Cello without prior permission in writing. It is forbidden to use the commercial emblems and the commercial image of the Operator and/or Cello concerning every product or service, in any way that it is reasonable to cause confusion amongst the customers and the consumers, or in any way that will underestimate or will create lack of trust in the Operator and/or Cello. All the trademarks that are not owned by the Operator and/or Cello or its’ subsidiaries which appear in the website are the property of their respected owners, which may or may not be affiliated with, in relation with, or sponsored by the Operator and/or Cello or its’ subsidiaries and you are forbidden from using them in any way without written consent from the Operator. Third party links and/or links to other sites that might be present on our website may not be controlled by us and we are not responsible for the availability, accuracy, or correctness of such third-party sites and/or any information, content, products or services accessible from such third-party sites. Once you leave our website and go to another site, be aware that those sites may have their own terms and conditions which might be different than ours and we recommend that you also review the privacy policy and terms and conditions of those sites. The Operator is not responsible for, and expressly renounce any and all liability related to actions of such linked sites, their terms and conditions or the content of such sites.
XVI. Duration and Terminating the agreement
The agreement between you and the Operator, established by virtue of the use of the Service and, therefore, the acceptance of these Terms and Conditions of Use is for an indefinite period.
You have the right to terminate the service, at any time, by notifying the Operator of your intention in writing or orally. It is hereby elucidated that terminating the service as mentioned, does not detract from your pledges to the payment of parking fees due to the use of the service or additional services or any other pledges which were created or made by you prior to terminating the agreement with the Operator.
The Operator reserves the right to terminate or refuse to provide you with the Services for any reason, including, but not limited to the following reasons :
- You did not uphold your pledges according to the conditions of use including but not limited to the pledge to the payment of the parking fees and payment of additional services, fully and on time.
- You abused the service which is to be decided in the Operator’s sole discretion.
- You provided us with essential information that is false, misleading, inaccurate or incorrect, or we are unable, by our own means, to verify or authenticate any information you provide to us, should we elect to engage in such verification.
- We have a reason to believe, at our sole discretion, that your actions may cause legal liability for you, other users, us or third parties.
Without limiting any other remedies, we may also suspend or terminate your account if you are found (by conviction, settlement, insurance or escrow investigation, or otherwise) to have engaged in fraudulent activity in connection with our service.
You agree to indemnify, defend and hold us, our subsidiaries and affiliates and each of our respective officers, directors, agents, employees, independent contractors and suppliers, harmless from any claim, demand, action, cost and expense, including reasonable attorneys’ fees, due to or arising out of any of the above reasons and/or events and/or your negligence or willful misconduct and/or your violation of any law, regulation or right of any third party.
XVII. Clarifications
Questions concerning the service should be addressed to the Operator’s customer services on the Operator’s public email or our call center (calls may be recorded for training, monitoring and quality control purposes). Questions concerning the conditions of use should be addressed at compliance@cello-park.gr
XVIII. Privacy Policy and confidentiality
The Operator will keep all your personal information which is in the Operator’s possession confidential and will not disclose any information to any third party unless required to do so for parking permit verification purposes (in which case the Operator will disclose the minimum amount of information possible) or ordered to do so by law or by court order.
Part of the information provided as part of the registration may be verified periodically (for permit verification purposes) against your existing identification details included in your files.
The personal information provided upon registration may be used to contact you in matters relating to your account and/or to the service. The Operator may also use that personal information to verify your identity should you contact the Operator in regards to your account and/or to the service. The Operator is bound by instructions or guidelines directed by the law and will respect and not harm your privacy. If you have any questions regarding our privacy policy, please contact our customer support center.
XIX. Data protection
In order to provide the functionalities included in the Application, the Operator requires the processing of your personal data. You may find more information about how the Operator collects and processes your personal data in the Personal Data Protection and Privacy Policy.
The acceptance of the Personal Data Protection and Privacy Policy by the User is mandatory to create a valid User Account.
ΧΧ. Security Policy
When joining Cello, your financial details are passed through a secure server using the latest 256-bit SSL (secure sockets layer) encryption technology. 256-bit SSL encryption is the current industry standard. If you have any questions regarding our security policy, please contact our customer support centre.
XXI. Governing law and jurisdiction
These conditions of use shall be governed and interpreted solely in accordance with the Greek laws. You irrevocably and unconditionally submit to the non-exclusive jurisdiction of the courts of Athens for determining any dispute concerning these conditions of use.
XXII. Severance
If any provision of these conditions of use is found unlawful, void or for any reason unenforceable, then that provision will be considered severable from the remaining Terms and Conditions, and will not affect the validity and enforceability of the remaining provisions. These conditions of use are the entire agreement between you and us relating to the service.
XXIII. Miscellaneous
The Operator will be entitled to pass and/or to transfer, at any time, its rights, and its debts towards the user to a third party, provided that the Operator notifies the user in writing fourteen (14) days in advance. Non-realization of the rights of the Operator according to the conditions of use does not mean that the Operator concedes them. The conditions of use will be demonstrated at all times in the website and the Application. The Operator’s announcement/s to the user according to the conditions of use can be made by sending an email to the email address the user has provided to the Operator. We attempt to be as accurate as possible when describing our Services. However, we do not warrant that the service descriptions are complete, reliable, current or error-free. If a service offered on the Website is not as described, your sole remedy is to cancel the Services.
All amounts stated anywhere on our website and/or app are in euros (€) unless clearly stated otherwise.
